Proposed Changes to HCV Project-Based Voucher Program Eligibility Requirements
24 CFR 982.553(a) requires Public Housing Authorities (PHA) to deny Project Based Voucher (PBV) assistance to families in which the PHA determines that any household member is currently engaged in the use of illegal drugs.
HUD regulation allows PHAs the discretion to define “currently engaged” in the context of current use of illegal drugs. Current BHA policy defines “currently engaged” as the use of any illegal drugs within the previous six (6) months.
BHA proposes to revise the PBV eligibility policy by redefining “currently engaged” as the use of any illegal drugs within the previous seven (7) days rather than six (6) months. The policy is as follows:

* The PHA determines that any household member is currently engaged in the use of illegal drugs.
BHA Policy: For families who will reside at a project which will provide supportive services and/or drug rehabilitation counseling, currently engaged in is defined as any use of illegal drugs during the previous 7 days.
